markets that seem to be looking for looking for directions searching for okay fed Cuts rates by a quarter point 25 basis points was expected this was definitely expected the markets were um definitely expecting I mean the FED watch tool on the CME Group website has been right now like minutes before was still saying a 99% chance it would be a quarter point cut but still this means interest rates will continue to go down John remember the entire reason the FED had to raise those interest rates that it’s affected everybody’s money was to tame inflation and so they got to a certain point where they decided there was some pain to the economy where they could start cutting rates and that’s what’s happening so you know a lot of speculation as to whether or not Trump would leave Jerome Powell in place at the FED uh once he takes office I’m seeing some reporting that he will leave him there but uh I guess the final decision likely hasn’t been made but with inflation on the way down and interest rates on the way down uh maybe the best change is no change can we pop a up real quick cuz it was about flat okay look at that it’s still about flat yeah there you go what’s interest what’s interesting hold on is this still reacting because the S&P 500 says it’s up 36 points that would be well watch this for a second okay huh I would imagine that since the the betting was 99% that there was going to be a quarter of a point rate cut that that’s already factored into what we’re seeing today in the Dow yeah okay all right so anyway yeah it looks like the Dow is not really reacting so maybe it wanted more maybe it just had already priced this in John and sometimes that’s just the case so so we’re going to be talking more about all of this and the way ahead in terms of the economy interest rates tax cuts with Ken Coleman from the ramsy show that’s just ahead I love it because the number one question I always get when there’s a change to interest rates is will I feel this we will ask him all right live look meanwhile at the White House briefing room where Ken Jean Pierre is set to speak for the first time since president-elect Trump’s sweeping Victory we expect she’s going to get some questions about that again first briefing since the election so we will be watching for that when it begins John and what does it all mean for President Biden’s Legacy and does the White House see Tuesday as a rejection of President Biden’s policies the president address the nation a short time ago here’s part of what he said you can’t love your country only when you win you can’t love your neighbor only when you agree something I hope we can do no matter who you voted for is see each other not as adversaries but as fellow Americans bring down the temperature hello and welcome everyone I’m Sandra Smith in New York and we’re all feeling it it’s been a week John good to be with you wouldn’t that be nice if somebody brought the temperature down after the president was one of the people who seemed to be cranking it up I’m John Roberts in Washington and this is America reports even as President Biden calls out Americans to turn down the heat it doesn’t seem that everyone in his own party is listening some Democrats already vowing to bring back the resistance if you try to harm New Yorkers or roll back their rights I will fight you every step of the way New Yorkers are resilient we fought the first time around and we’ll fight again we faced this challenge before and we use the rule of law to fight back and we are prepared to fight back once again and I worry that Donald Trump is more embolden than he’s ever been and that a second Trump presidency is likely to be more vindictive than the first are Allstar panel of Shan Duffy and Brian kilme are here I can’t stop talking to them already John all right but first to our senior White House correspondent Peter Ducey is live on the North Lawn Peter and John just like every transition two days in we starting to see the push and pull of presidential authorities Donald Trump and his team don’t yet have the Resolute desk but they are down in Florida working on executive orders for day one so I wouldn’t want to go and necessarily put it over under but I think you can see specifically when we talk about the border and with the energy exploration he will be ready to go literally on day one with many of these uh but I wouldn’t want to say the exact number cuz they’re not all necessarily weighted equally but the bot bottom line is he’s going to move Qui he’s going to move quick that’s why General Mali Dylan the Harris campaign Chief is telling Dems the work of protecting America from the impacts of a trump presidency starts now and that’s got President Biden insisting he actually set in motion plans and projects that are already working they might just take a couple years it’s been a historic presidency not because I’m president because what we’ve done what you’ve done the vast majority of it will not be felt we felt over the next 10 years we have a we we have legislation we pass it’s just only now just really kicking in and so as there is talk about Trump proofing the Biden administration’s accomplishments President Biden is basically daring Republicans to try to do that suggesting that it is going to take a long long time back to you Peter Dey for us as we await the White House briefing Peter thank you Sandra okay two months inauguration day which means the Trump team is busy at work reviewing names for key cabinet posts one of the names reportedly being floated for a role is Florida Senator Marco Rubio Senate Intel committee Vice chair and Senate Foreign Relations Committee he joins us now thank you so much Senator great to see you so first up are you up for that job and and it is it happening have you heard anything well first of all like anything that happens under any Trump Administration that there’s one person that’ll make those decisions and his name is Donald Trump and um he’s been focused on winning an election not what’s going to happen next he’s got great people working on that the answer to that question is I don’t know I haven’t talked to them about any of that but obviously you know that’s the season we now enter into in speculation I know I’m in the Senate and I know that in the Senate I’m going to be there ready to work and get a lot of these good things done that are going to require legislative action but uh the other stuff you know they’ll play he’s going to make great choices look at pick of JD Vance every turned out to be a fantastic pick he had really good people working with him the first time and he’s got really good people working on it now and when he focuses in on it uh as I imagine he’s starting to do you know we’re going to start getting those decisions and and I’m going to be working with them one way or the other all right well we’ll keep on following that is we play the uh the Washington parlor game of who’s going to be in the in the cabin and who’s not uh you probably heard Peter ducey’s Report just a moment ago about the rise of the resistance got Kathy hokel Leticia James Gavin new out in California is calling a special session of the legislature to try to Trump proof California I I feel like I’m watching a Star Wars movie here the resistance is Gathering already against the Trump presidency what does he need to do senator in order to govern effectively because he’s going to have all these people trying to upset the apple cart well first of all resistance to what resistance to what the American people just voted for in the history of the Republic no candidate for president has been clear about what they’re going to do in the simplest language possible he’s going to secure the Border he’s going to bring down prices for energy and other things in America and he’s going to make us strong in the world so that we don’t have a war he’s been very clear about this I mean no one’s been more explicit and people voted for that overwhelmingly this is the landslide it’s an electoral college Landslide he won the popular vote even in states that he didn’t win Virginia New Jersey I mean these are states that became incredbly more competitive the state of New York was more competitive so what are they a resistance to the American people this is their attitude their attitude is you guys are a bunch of dummies we’re really smart people we know what’s best for you uh you you don’t even know what’s best for yourselves and that’s why they lost this election and that’s why they’re going to to lose elections as long as they adopt that attitude a resistance to what you played earlier clips of the what attorney jov she is in New York uh the the the mayor as well the governor as well these are just Democrat politicians that sense opportunity their party is down they’re this is a chance for them to step up and make themselves the face of the future of the democratic party but I keep asking they were resisting what they are resistance to the American people that just voted Donald Trump into office overwhelmingly Senator it’s been a while since we’ve had you on and and had the the chance to chat and obviously this is just a couple days after a very historic moment for the country how would you describe this moment for your party well the Republican party has fundamentally been remade in a very positive way it reflects a multi-ethnic multicultural uh Coalition of Americans United by that I think it’s a example that our primary identity as people is not our ethnicity or our SK skin color okay it is the fact that we’re mothers and fathers that we’re small business business owners that were workers and employees who work for wages who have to pay bills who want their kids to have a better future but are struggling with the cost of housing and everything else who are worried about some War breaking out that might suck their children in who that into serving uh in combat who are worried about these things very deeply and by the way in in Hispanic communities in particular deeply worried that some criminal from somewhere in the world gets into this country illegally and comes to your neighborhood and murders someone that you love because it’s happened and that’s the neighborhoods that many of them going to so the Republican party now reflects this governing Coalition for the country now we have to make that turn that into action that helps you win an election now you have to do the things that respond to why people voted this way in the first place and if you do that I think it helps not just strengthen the Republican party I think it gives us a governing Coalition that starts to break some of the gridlock that has kept us from doing things meaningful things for our country in a long time but that’s the opportunity it’s got to we got to go out and do it right but I feel good about it but now we’ve got the actual work to do yeah uh to to your point about the Republican party they growing the tent here there’s a couple of things I wanted to take a look at in terms of the election results first of all star County Texas here’s the results over the last uh three elections 2016 this is a heavily Hispanic District 2016 Clinton beat Trump 79 to19 Biden beat him 5247 but look at this the county flipped 5741 in Trump’s favor now let’s look at your home state Florida 2016 Trump won at 4947 he won at 5148 in 2020 but then look at this on Tuesday he won at 56 to 43% and you know and a large part of that was Hispanic voters particularly in Miami Dade County saying you know what Trump’s our guy if if you can grow the Hispanic vote that quickly what does that Bode for the future for a Republican party that just three years ago Democrats were saying we’ll never win another election because it’s so fractured well I think it begins but my free advice of Democrats is fire all these consultants pollsters and so-called experts that gave you advice on how to reach the Hispanic vote because they don’t know Jack okay the truth of the matter is that Hispanic voters are not in favor of illegal immigration they are not in favor of uncontrolled immigration into our country they’re not in favor of allowing criminals to roam our streets and kill murder rape they’re not they’re not in favor of any of those things Hispanic voters are not in favor of high prices that makes life unaffordable and they’re not in favor of policies that send our jobs to other countries it’s and you know what neither are most Americans so here’s the headline Hispanics Hispanic Americans are Americans and they believe and feel about these issues the way all Americans feel and I think that extends to other communities as well it goes back to my earlier Point our primary identity is not the color of our skin it’s not our ethnicity it is how we live our life on a daily basis and it’s hard for everyday people so yeah they had all these great endorsers you know Bad Bunny didn’t deliver for KLA Harris okay Jennifer Lopez didn’t deliver for KLA Harris because the average voter is get you know even in the Hispanic Community they’ll listen to the guy’s music but they don’t give a damn what he thinks about this cuz they he doesn’t have to pay the bills they have to pay know no one’s going to murder him some illegal migrant across the border murder him but they’re worried about it because they’re coming to their communities so I think that’s what this is proof of and you’re seeing it play out you talk about that border region County of course they voted for Trump it’s migrants are coming across their neighborhood where they live they’re not in Beverly Hills watching some PBS documentary about this they’re living it every single day yeah um can I just finish off where we started so your name’s floated around for a secretary of state if you’re asked you would serve in a trump Administration Senator well I’m going to work with the Trump administration at whatever capacity they feel is best I’m not presumptuous to say they’re going to pick me Donald Trump makes that decision and he makes good decisions about the people that work for him I’ve not talked to them about it um so but I mean ultimately what I’m F I know I have a job right now and that’s in the US Senate if something else comes about and that’s a decision they make then obviously you know we’ll cross that bridge when that moment comes but we’re not there it’s way I think it’s still kind of early to think about those things um we were 48 Hours removed from from this Victory about all that work to do you got to get started early right Senator it’s been a minute good to catch up with you again thanks Senator thank you all right all right now let’s bring in Shan Duffy Coast the bottom line Fox Business and Brian kill me Fox and Friends coast and host of one nation care to share anything about what you just heard there Brian I think Mark ruia would be the number one pick I think it’s a really good pick because number one I think he work with Central and South America and Cuba with the president the president gave him some free reign too to do some work back there and I think they really appreciate each other remember they were tearing each other’s eyes out perfect example of how okay it’s over you won how can I help and as a senator I think they their respect for each other grew and I think that that’s exactly the job he wants personally I don’t think he loved being Senator I I think he had to be convinced to run the last time when the play presidential run didn’t work out for him when he lost to Trump and he went back 2016 I think I think he would love to be Secretary of your reaction real quickly as as I do note just fascinating hearing about him talk about the Hispanic community and that vote count I mean early in the night we were looking at our Fox News voter analysis and you just started to see how she was underperforming with these key minority groups the Hispanic vote it was just below where Trump uh Biden was in 2020 and you started to see it all over the country Sean Hispanics blacks young uh individuals women I mean the whole he was losing everywhere but listen I think whether it’s Bill Hagerty Senator or Marco Rubio I think those are truly being considered right now you go back to 2016 uh Donald Trump knew to DC I think he admits that he did not do a good job vetting and getting good people into his administration he learned his lesson and so now um he’s truly going through the process we’re seeing a lot of names come out and you mentioned uh those names at the top of the 1:00 hour what’s interesting is some of those are real but another game is being played as well people are pushing their names into the media and trying to get talked about even though they’re not being truly considered by the administration and so some is real some is not uh the only one who truly knows right now is Donald Trump down of mar Lago as he’s kind going through thinking through don’t you agree that he has to name a a chief of staff soon don’t you think that should be first because then they can set up a schedule and the interviews that go like that I suspect uh that he has that figured out I he does and that’s probably happening now that might not be it’s got to be Susan W she’s already proven herself in the most difficult time period reportedly she she gets the job she wants it it’s already made it clear no drama right I mean a campaign and it was and you didn’t see her she was not out in the Forefront she was it was keeping the buses running on time and did an excellent job this is some sound it was interesting hearing talk about Jennifer Lopez right the senator um talking about the celebrity endorsements you know Democrats just they kept pushing for the celebrity endorsement thinking that would work I mean to the point where this is some of what they convinced their voters their supporters at these rallies that it would work this is some of those voters at a Harris Detroit rally listen I think it uh May influence some younger the younger generation depending on the generation and the genre of you know I definitely think that they do so I think that it’s very important that when they do endorse somebody it’s meaningful and it’s intentional I think that people admire these uh celebrities and I think that they do have a um opinion about where they should go and I think that U for the most part they’re more educated than the average person they might admire them they might listen to their music or watch the movies but does it influence their vot I think celebrity endorsements are done forever I really do uh because you look you couldn’t get bigger star power you got JLo you got Beyonce you have Lady Gaga you had Taylor Swift cardi b Bruce Springstein comes out to any every Democrat every time and what does it do it gets people who little resentful I think we I think more and more people yeah Oprah Oprah so I think people have that resentment because they feel as though they look down on you celebrities and now all of a sudden you’re going you’re telling him oh because Bruce Springsteen’s a good singer he’s good at picking a president I don’t I don’t buy it I think they’re done I thought the best position was to see the celebrities with kamla Harris and see the steel workers behind president Trump in Pennsylvania Trum the celebrities too I mean to be clear yeah and not to the same extent I do think again celebrities can can bring people into your crowds maybe if you need that K Harris did Donald Trump doesn’t but it was really policy right people are suffering they they I mean again Middle America where I’m from uh they are having a hard time at the grocery store and the gas pump and insurance bills uh and so they go who’s speaking to the needs that I have know the price of a gallon of milk Beyonce does not know cuz she probably hasn’t bought a gallon of milk in a long time but I do and it I’m getting crushed and so I want to hear your music beyon but Donald Trump’s going to fix it for I just want to know how many gallons of milk for the Duffy household I mean about five to six a week right seriously and I buy them at the same time and I stack the outside fridge with them so otherwise I’m going to the store all the time for milk do you churn your own butter I do it heavy whipping cream right and then you get buttermilk and butter it’s really good salted to Perfection yes I have chicken I’m just picturing Sean pushing the cart through the grocery he’s got six Gall milk you know he’s a lumberjack very heaping very big and by the way you’ll feel the prices when you’re shopping for people at home it’s real the big difference is when you said so he Trump Ed celebrities too yeah he uses Brett Favre because Brett Favre is a rockar in Wisconsin I never did this before but this guy can help me I think that’s a lot better than Lady Gaga I’m good at the piano so I just don’t I think there’s there’s people piano Brian I mean this is I do mention the piano I I just just I see the concert I don’t hear the candidate football is more effective than playing pianos Wisconsin yes that’s true he knows how to survive a winner in Green Bay all right thanks to both of you all right John sounds like the Duffy Clan qualifies for its own cow we know Republicans have retaken control of the Senate but with some RAC incumbent uh Democratic senator Jackie Rosen moved slightly ahead of the Republican Challenger in that race Sam Brown for the very first time Fox News National correspondent Jeff Paul’s in Las vas Las Vegas for us been a long week Jeff what is taking so long there with all of that well yeah Sandra I mean the short answer to that question is that the races right now are just too close and there are still too many outstanding ballots that need to be counted and at the moment Nevada estimates they have tens of thousands of ballots that still need to be counted throughout the state in a bulk of of those ballots are coming from Clark County which is a solidly blue part of the state and includes Las Vegas but what’s also delaying the process there are thousands of ballots that need to be cured the main issue officials are seeing surrounds signature verification which voters have until next Tuesday to fix it’s very important that people come out and cure their ballot if they uh want their ballot to count um I think unfortunately a lot of people won’t cure because the numbers are so high they the person they voted for already won so here’s where things stand at the moment Donald Trump right now is ah head of commala Harris in Nevada by roughly four points but when you look at the senate race here it’s even closer Democratic incumbent Senator Jackie Rose it now leads by about 1 percentage point over Republican Challenger Sam Brown so we still got a lot of ballots coming in could take some time until they finalize those results Sandra okay Jeff Paul in Vegas for us thank you Jeff John all right Jeff we want to dip into the White House briefing here for a minute Ken John Pierre has been asking been answering some questions about why Biden stayed in the race so long before dropping out let’s listen in incredibly proud of her and when he did decide to step aside he immediately endorsed her and the party unified behind her they did you said that my my question is just if you can or want to address the criticism that’s being directed at him for this loss there’s going to be a lot of people who are going to say a lot of things there’s going to be election experts who are going to look under the hood in the next couple days and weeks and months as I’ve said already and they’re going to have their opinion on this race what I can say is that and this is something the President says all the time you get knocked down you get back up and the president said this moments again uh you know uh this is a defeat but we are not defeated and the president believed he made the right decision on behalf of the American people on behalf of this country to step aside and we saw what happened in 2022 after the midterms we saw where we were at that time and this is how elections are this is it es and flows you win you lose and this is where we are today what we’re going to focus on is respecting the American people and how we move forward in the next 74 days okay thank you Karine you talked about the influence that the 2022 midterms had on the president’s thinking to decide to run for a re-election but around that time in 2023 poll showed that roughly 80% of Americans believed at that time that the president was too old to serve another term did he believe those voters were wrong what he believed is what 14 million voters decided in the primary to make him and the vice president obviously she was on the ticket the nominee that’s what happened 14 million uh for for this current uh past primary 14 million Americans decided that so they made their decision on who they wanted they did uh that was decided um now as we know in July the president made a decision to step aside and he immediately again uh decided to uh without thought without you know second guessing uh endorsed the vice president so you had 14 million Americans who made that decision in the primary but around that time in 2023 the president’s team also uh very firmly encouraged other Rising Stars luminaries in the party people who had participated in the primaries in the 2020 cycle um to Rally behind the president and not to consider their own Ambitions was that the wrong call I’m not going to get into conversations I I I’m not going to get into that uh reporting uh it is not unusual for people to Rally behind uh the uh the leader of the party in this case is part me in this case is Joe Joe Biden for the Democratic party it is not unusual for that to happen uh I’m not going to relitigate or get into uh what was said not said I actually don’t have any information on that uh what I can say is what the president decided to do uh what this the president believed and what the president’s going to continue to do is put the American people first that is the most important thing for him back does the president have worries about what the country and what this office will look like after January 20th look um the president is going to certainly again respect what majority of Americans decided uh they decided they wanted uh Donald Trump to be president uh and he’s going to respect that I don’t want to get into hypotheticals about what’s going to happen in the next Administration not happening in the next Administration uh we are proud the president is incredibly proud of what he has been able to do of for the American people and that’s going to continue to be his Focus I talked about the legislative focuses that we’re going to have in the next 74 days uh and he wants to continue to implement those historic uh legislations now laws that he was able to get done um and you know the next Administration is going to inherit a strong economy which he’s very proud about uh but I think for now I’m going to leave it there and does the president hope to meet with the president elect before leaving to go to South America where he’ll meet with world leaders what I can tell you it’ll be in the near future we have to we’re going to work that out our um certainly his staff is going to work with the staff of the president-elect to find a time that works for both um I can’t say the timing just yet uh but certainly you all will know when that occurs uh but I can say for sure it will be in the near future okay uh thank you P so does uh the president believe that he could have beat uh Donald Trump what the president believes is that he did the right thing for the American people I’m not I’m just I’m not going to get into uh uh you know what could have would have he believed he did the right thing he believed that the vice president ran a a really a great campaign uh he’s incredibly proud of what she’s been able to do and how she was able to unify the party and how she stepped up and was able to get uh to to get running uh with a with a uh impressive campaign and so that’s what he believed he thought it was the right thing to do and here’s the thing the party unified beh behind her and I think that’s what is important uh he did the right he believed he did the right thing so uh Republicans have threatened to uh repeal the inflation reduction Act um does the White House have any plans to take any actions to safeguard some of the measures such as you know clean energy Investments for instance so a couple of things I do want to talk about the inflation reduction act that is a popular piece uh of legislation obviously that became law uh that is uh when you think about climate change the most comprehensive uh law to be passed to deal with climate change I talked about beating uh big farmer when you think about uh Medicare now being able to negotiate and not only that you’re obviously to negotiate to lower uh cost I mean there is so much that came out that comes out of the inflation reduction Act only Democrats voted for it for it you have heard us warn about Congress trying to repeal that and it is popular we saw what happened when they tried to repeal the ACA uh the Affordable Care Act which became popular and helped tens of millions of people get health care and so that should be a warning for them that should be a warning for them not to go after something that actually helps the American people that actually delivers on key key priorities uh and that is actually popular so I I’ll leave it there good John thanks all right so there’s Karine janpierre with the very first White House briefing since uh the election on Tuesday night saying that it is the intention of the administration to respect what voters wanted to see and facilitate a peaceful transition of power a lot of talk too Sandra about whether or not the president’s ego got in the way that he hung in for so long but you could posit the answer that regardless of when he got out if he got out in the summer or if he got out late last year and allowed a competitive primary process that what American voters really wanted to see was Trump returned to the Oval Office and it wouldn’t have made any difference and that final answer there with a warning to them about leaving certain Biden policies in place uh when she was addressing the inflation reduction act putting in place obviously to bring down Skyhigh inflation that was happening under this presidency um that was interesting and and by the way one of the main reasons that that Trump is taking back office people are frustrated with those high prices they certainly are all right let’s move on now President elect Trump receiving a lot of support from Hispanic voters across the country Fox News voter analysis finds 41% of the demographic voted for Trump much of the support coming from border counties in southern Texas Paul Perez National border patrol council president joins me now uh first of all Paul and good to have you on for the first time since the election how do you think policy in the border is going to change come January 20th well obviously we’re going to see a lot of changes we’re going to see a lot a more secure border like what we had when President Trump was in his first term he’s uh got a lot of people that are going to be good to work with that are going to come in people like Tom Holman that have a strong back ground that know exactly how to do this but president Trump’s going to be leading the way so we’re going to see less activity on the border between now and then between now and the time that that President Trump comes in we may see an influx because they know that he is going to strengthen the border and shut it down so we may see an influx between now and then because we know this Administration is going to maintain the status quo and allow as many people as they can to come into the country but once president Trump is in office that ends and so we’re going to see a lot of changes coming all right so I was really curious and we mentioned this at the top to see how president Trump increased his support among Hispanic voters 2024 results in Star County Texas Trump won at 57 to 41.8 what’s really interesting about that is he lost that County which is heavily Hispanic right along the border there just west of Mallen Texas he lost it by 60 points in 2016 and take a look at this the Fox News voter analysis Latino voter preference 2020 versus 2024 2024 Harris got 56% Trump 42 in 2020 Biden got 63% Trump 35 so Trump increased his support by seven points where it went down by more than that on the Democratic side to to what do you attribute that shift well number one it’s not a surprise this area where where I’m at the Rio Grand Valley I’m I’m in clayberg County uh which covers Kingsville and everything South what we saw was nothing short of amazing but I can tell you why the people here it’s been ground zero for the influx of criminals illegal immigrants coming across and the people here saw it firsthand they got frustrated they weren’t buying what the Biden Administration was selling which was hey there’s nothing going on in the Border it’s a controlled border they got to see it these were people that live on the border in some of the poorest areas in the country and they supported Trump not only because of the illegal immigrant influx because of what the economy was doing they were being devastated and so they did what everybody knew they were going to do they were going to do the right thing based on the facts not on the rhetoric and it was a big change and it was coming because of what they have seen firsthand nobody has seen what they’ve seen we’ve got a lot of codell that have come down here that see it they get surprised because it’s something to see with your own eyes yeah I mean even the Democratic members of Congress in that area saying something’s got to be done so there’s a big question about what happens between now and January the 20th when Trump resumes the presidency here’s what our bill maluan put out on X the other day something to monitor will there be a wave of migrants at the border between now and January hearing the same concerns from several contacts within border patrol however they point out that threats of mass deportation may cause enough hesitancy to negate a rush Paul you’re on the front line there along with your members what do you think is going to happen between now and the 20th to January so it it is very possible that there’s an influx because they know that come uh the time that President Biden gets inaugurated they’re going to shut it down it’s going to be a lot harder to cross the border and so what this is going to do is going to drive up the profits for those Smugglers so we know that President Trump’s also going to go after the cartels that it’s too broad and essentially could apply to every first-degree murderer the brutal murders of four University of Idaho students in an off-campus house took place exactly two years ago next week cerer was arrested and charged with murders less than two months later and now his attorneys argue that he should not face the death penalty if convicted Idaho is one of 21 states that still uses he said he was an apparent drug user and and he was very dirty I didn’t want my officers to put their lips on his mouth there’s a certain line where you have to protect your officer I wouldn’t want one of my officers getting sick from this Paul yeah well he’s right um first of all the case is almost certainly not going to turn on this criminally um there’s a vague way it could have some impact but realistically this could only come into play of in a civil suit later on but the cops are under no obligation to do that especially in a circumstance when this Sergeant judges that this person may present a threat to the health of his officers for instance hepatitis is the real thing that you’re at risk for the equipment they’re talking about is not a required item it’s a plastic sleeve that you can use to give mouth to mouth most cops realistically just don’t have it on them so as unfortunate as this is and the fact that they did have a faint pulse you know that is an important fact but they really are under no obligation they did what they could and they’re not doctors or Medics their obligation is to call EMS right away which they did another key part of this witness testimony judge is a description of ne’s behavior at um the tone was scary according to this witness violent and desperate uh this is AET Rosario a teen witness saying I got scared by the tone that he was saying it I’ve seen situations but not like that I just wanted the doors to open so I could get away how important is that I think it’s extremely important because the reasonable man because we have a defendant who’s a male here is going to be determined by what they experienced in that cour in that in that moving car and so the fact that she was frightened even though she had ridden the subway before for she said she was so scared she felt like she was going to pass out she was praying she put her head in her friend’s chest those are her words and they were uh this guy comes on the tone is angry he throws his jacket down he says I’m ready to die someone’s going to die today I’m ready to go back to jail it’s clear he lunges toward a woman who has a carriage with a baby in it so everybody has a little piece this is like a puzzle the main characters are the characters who were in that subway car when it was underground and moving not the people kind of afterwards or came in and then took a video it is the tension and the fear and the horror that these sub strap hangers experience so what will this case turn on Paul exactly what the judge just said this is very much a state- of Mind case let’s remember what he’s charged with manslaughter and criminally negligence homicide this is going to turn on recklessness on negligence in Daniel Penny’s mind now if Penny takes the stand he’s going to say that he was scared and that he had to do had to do that his actions were commensurate of course he’s going to say that what you want as the defense is Witnesses other states of mind to be the same as his to say we were scared out of our wits and what he did was necessary let’s remember another little factoid that’s coming out now too the justification uh supposedly ostensibly for the fact that NE Gan he screaming in yell and he said he was hungry but when they searched him he had a muffin in his pocket so like there these little facto the judge says that little puzzle piece coming together now that make it look a little bit less dire I would argue for the defense well it wasn’t a question of whether he was hungry obviously we were dealing with mental illness drug abuse
